2. Scope

2.1 This privacy policy applies to the website www.s-prestige.ch in German, English, French and Italian, as well as to all contact, booking and business relationships initiated or conducted with SPG through this website, by email, telephone, WhatsApp Business, or via our profiles on Instagram and TikTok.

2.2 We process personal data primarily in accordance with the Swiss Federal Act on Data Protection (FADP). To the extent personal data of persons resident in the EU is processed, or the EU General Data Protection Regulation (GDPR) otherwise applies, we additionally observe its requirements.

3. Principles of Data Processing

3.1 We process personal data lawfully, in good faith, for specified purposes and in a proportionate manner. We collect only the data required for the respective purposes and do not retain it for longer than necessary.

3.2 We disclose personal data to third parties only to the extent required to provide our services, to comply with legal obligations, or on the basis of corresponding consent.

4. What Data We Process and For What Purpose

4.1 Visiting the Website (Server Log Files)

When you access our website, our hosting provider automatically collects technical data (including IP address, date and time of access, page requested, browser type, operating system used, referrer URL). This data is used for the technical provision and security of the website and is not merged with other data sources.

4.2 Contact and Booking Enquiries

If you contact us via the booking form, email, telephone, WhatsApp Business, Instagram or TikTok, we process the information you provide, in particular your name, email address, telephone number or username, company, country, as well as travel details such as type of service, number of passengers, departure and destination location, requested dates and times, and baggage details. We need this data to process your enquiry and to prepare a quote for you.

4.3 Passenger and Flight Data in Connection with a Booking

Once a charter order is concluded, we process additional data required to carry out the flight, in particular full names as shown on travel documents, dates of birth, nationality, passport numbers and, where applicable, health- or customs-related information. This data is provided to us by the customer and is required for disclosure to the operator and the relevant authorities (see clause 6).

4.4 Payment Processing

For invoicing and payment processing, we process billing and payment data (including billing address, payment references). Credit card or bank account data, where required for payment, is processed directly via the payment or banking channels used.

5. Legal Basis for Processing

5.1 To the extent the GDPR applies, we base the processing of your personal data in particular on the performance of a contract or pre-contractual measures taken at your request (Art. 6(1)(b) GDPR), on compliance with legal obligations (Art. 6(1)(c) GDPR), on our legitimate interest in a secure and efficient business operation (Art. 6(1)(f) GDPR), and, where required, on your consent (Art. 6(1)(a) GDPR).

5.2 The Swiss FADP does not provide for a system of legal bases identical to the GDPR; we process personal data in accordance with the principles set out in clause 3.

6. Disclosure of Data to Third Parties

6.1 To carry out a booked flight, we disclose the passenger and flight data required for that purpose to the operating carrier, to airport and ground handling service providers, and to the competent authorities (in particular border, customs and aviation authorities). This disclosure is strictly necessary for the flight to take place.

6.2 We also engage carefully selected service providers who support us in operating the website and processing enquiries, in particular hosting and infrastructure providers as well as providers who process form submissions. These service providers process personal data exclusively on our behalf and in accordance with our instructions.

6.3 Any further disclosure to third parties, in particular for advertising purposes, takes place only with your consent or on the basis of a legal obligation.

7. Processing of Data Abroad

7.1 Our website is provided via a hosting and content delivery provider (Netlify, Inc., USA); our form service provider (Web3Forms) and certain other service providers may likewise process data on servers located outside Switzerland and the EU, including in the USA.

7.2 In the assessment of the competent authorities, the USA does not consistently offer a level of data protection equivalent to that of Switzerland or the EU. We therefore ensure, where required, through appropriate measures, that an adequate level of protection is guaranteed — in particular by engaging providers that participate in the Swiss-US or EU-US Data Privacy Framework, or through the conclusion of recognised standard contractual clauses.

7.3 In connection with carrying out a flight, the transfer of passenger data abroad is also unavoidable, namely to the operator, to foreign airport and customs authorities, and to authorities at the flight's destination.

8. Communication via WhatsApp Business and Social Networks

8.1 In addition to email and telephone, you can also contact us via WhatsApp Business and via our profiles on Instagram and TikTok. If you contact us through these channels, we process the information provided in that context (e.g. name, username, profile picture, message content, contact details) to respond to your enquiry, based on the same purposes and legal bases described in clauses 4 and 5.

8.2 WhatsApp Business and Instagram are operated by Meta Platforms, Inc. or affiliated companies, and TikTok by TikTok Technology Limited or affiliated group companies. Responsibility for data processing on these platforms themselves (e.g. account creation, usage data, the platform's own advertising tracking) lies primarily with the respective provider; their own privacy policies apply in addition. We have no influence over this processing.

8.3 Use of these services may result in your data being transferred to countries outside Switzerland and the EU, including the USA and, in the case of TikTok, to group companies outside Switzerland and the EU. We recommend not sending sensitive information (e.g. passport data or payment information) via these channels, but instead by email or through the booking form.

9. Cookies and Similar Technologies

9.1 Our website currently uses exclusively technically necessary cookies or comparable storage technologies required to operate the website and the booking form (e.g. language setting, session management). These do not require consent.

9.2 Should we in future use analytics, marketing or advertising cookies (e.g. in connection with Google Ads or retargeting measures), we will inform you in advance via a corresponding cookie banner and, where required, obtain your consent. This privacy policy will be updated accordingly in that case.

10. Retention Period

10.1 We retain personal data only for as long as necessary for the respective purposes or as required by statutory retention obligations, in particular commercial- and tax-law retention periods of generally ten years for accounting-relevant documents.

10.2 Enquiries that do not result in a booking are generally deleted within 24 months of the last contact, unless further retention is required.

11. Data Security

11.1 We take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse or alteration. Our website is transmitted in encrypted form (SSL/TLS).

11.2 We cannot guarantee end-to-end encryption for communication by email or WhatsApp; sensitive information (e.g. passport numbers) should, where possible, be transmitted via secure channels.

12. Your Rights

12.1 Under applicable law (FADP or GDPR), you have the right to request information about the personal data we process about you, to request its rectification or erasure, to request restriction of processing, to object to processing, and, where applicable, to request the transfer of your data in a commonly used format (data portability).

12.2 Where processing is based on consent, you may withdraw that consent at any time with effect for the future.

12.4 We do not make decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.

13. Minors

13.1 Our services are aimed at adults with legal capacity to conduct business. We do not knowingly collect personal data of minors without the consent of a parent or legal guardian, except where this occurs in connection with a booking as an accompanying passenger arranged by the booking customer.

14. Changes to this Privacy Policy

14.1 We may amend this privacy policy in order to adapt it to changes in the law or to changes in our services or in our data processing. The version published on the website at the time of your visit or enquiry shall be authoritative.

15. Supervisory Authority

15.1 You have the right to lodge a complaint with the competent data protection supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC, www.edoeb.admin.ch). Persons resident in the EU may also contact the data protection authority of their country of residence.
